These terms apply to the studio, the site and each commission.

MARKSAKE is a China-based studio offering made-to-order keepsakes from original drawings, handwriting, lettering, recipes and other customer-provided marks. An order is a request for us to make the selected item. Product availability, materials, personalisation options, price, delivery charge and destination terms are shown on the relevant product page or at checkout.

We may update the site, products or these Terms where reasonably necessary. The version in force when you place an order applies to that order, unless a change is required by law or benefits you.

We review a commission before work begins.

Orders are subject to availability, payment authorisation, address verification, fraud and operational review, and the suitability of the submitted material. We may ask for clarification, decline, cancel or limit an order where a price or description contains a material error, content cannot lawfully be reproduced, or the request cannot be made to the required standard.

An acknowledgement that we received your order does not by itself mean acceptance. If we cancel an order before production for a reason attributable to us, we will provide the appropriate refund for the affected amount.

Your mark remains yours.

You retain ownership of the drawing, handwriting, text, image or other source material you submit. To assess, proof, make, fulfil, support or, where appropriate, remake your requested piece, you grant MARKSAKE a limited, non-exclusive permission to technically prepare and reproduce that material for those purposes only.

You confirm that you created the material or have all rights, permissions and consents needed to share and reproduce it. Do not submit third-party brand logos, celebrity images, copyrighted characters, copied artwork, private information about another person, or material that is unlawful, abusive or otherwise unauthorised.

Approval is the point at which the commission moves forward.

Where a proof is offered, please check spelling, layout, scale, placement and selected options carefully. The proof is the agreed interpretation of your original mark. Physical materials can create minor differences in colour, texture, scale and placement; we will not intentionally substitute a materially different design from an approved proof.

Personalised production starts after the required order details and source material are ready and, where relevant, the proof is approved. A change or cancellation may be possible only before production preparation begins. A request is not accepted until we confirm it in writing.

Checkout shows the price for the order you are about to place.

Prices, available payment methods, delivery charges and any taxes collected at checkout are shown before you submit an order. Obvious pricing errors may be corrected before acceptance. Where import duties, import VAT or carrier handling fees are not collected at checkout, they may be charged separately by the destination country or carrier.

Payment details are handled by the payment provider selected at checkout. We do not ask you to send card details or identity documents through the contact form.

Use the site fairly; keep the protections the law gives you.

The MARKSAKE name, site design, written content and original studio graphics belong to MARKSAKE or its licensors and may not be copied or used commercially without permission. Do not misuse the site, interfere with its security, scrape data, upload malicious code, attempt unauthorised access or impersonate another person.

To the extent permitted by law, MARKSAKE is not liable for indirect or consequential loss arising from site use, third-party services or events outside our reasonable control. Nothing in these Terms limits rights or remedies that cannot be excluded under the consumer laws that apply to you.
